I stumbled across this auction and guess what I saw? The last picture from the bottom looked very similar to one of my old photos I took. And I remember each one I have taken precisely. So I busted out the old photos and low and behold, the ebayer and cropped my photo, blown it up, and slapped his logo all over it. So I'm kind of perturbed about it. What can I do about it. I wrote him an email concerning him about it. Should I contact ebay and tell them about misuse of copyrighted material?

At first i thought you were losing your mind ....LOL.... But your right it is your photo..... you can see the red on your caliper and the hood and where the bumper meet are the same ..... Well good luck you might get something free out of this..... But your doing the right thing e-mail him first ....keep us posted .

email ebay ASAP and they will end the actuion this is ur pic and u have a implied copyright on it....

I have the form to fill out and fax to ebay about intellectual property infringements. I also emailed the company that used my photo in the auction. I checked out the website and they have my photo there too! WTF I'm definitely going to threaten to take legal action. How dare they try to make profit off of my picture. At least pay me royalties for its usage.

I tired to file a complaint to ebay but I have to fax stuff to them and I don't have a fax. Do you know the number for Ebay?

Copyright isn't implied, it's something that takes effect immediately when someone creates an original piece of "intellectual property" and protects you from any unauthorized use, etc.

So, on topic... contact them, and have the guy banned or whatever they do there.

no way, tell them you're calling your lawyer if the auction isn't shut down. that will make the seller pee his pants.

no because ive tried saving pictures from car domain for personal album and ideas , you cant. well , you can save them to your cpu , then post , but not from a wab url. did you host your pictures on a public domain , like photobucket?

they most likely wont take the auction down , but they will , make the seller remove the pic , and contact you to resolve.

I just found the a way to email a message to ebay. So now I hope they can take down the auction. Now I'm going to have to get my picture off of the website as well.

did someone take your picture from cardomain? where was the picture copied from? are you sure that when you submit your photo to cardomain that the picture doesn't become public domain? if the photo becomes public domain, then the ebay seller using your photo has every right to play with it.

double check car domain's disclaimers and privacy blah blah blahs.. i hope you have a case!

According to intellectual property rights, any form of art or images posted on the internet automatically has a copyright of the original owner. I'm just waiting on their response. If they don't respond or if they refuse, I will threaten with legal action. I already sent ebay an email asking them to take down the auction.

Yes, they jacked it from my cardomain and I didn't have it on my photobucket. Its just pissing me off. If they had asked me, I probably would have let them use it, but they use it behind my back and try to make a profit from using it. WTF

you can get a hold of the guys if contacting ebay doesnt work and tell them you want to take them to court or something. or sue them hahaha.
