    FFFFUUUUU blew a .081. It wasn't anything serious, he fined me that was it. st. pattys day they are relaxed on the "close calls" fcking 500 dollar fine. no jail time.

    He was relaxed on me because my buddy blew a .10.But I still have a court date. My lawyer said it will more than likely get dismissed because it was a voluntee and not a licensed officer who gave me th test Which wasn't witnessed by a cop. They also refused me a blood test becaue they didn't have on site paramedics. So it will most likely get dismissed or have reduced.

    I looked at the ticket today and it'd actually 800 dollars and 8 points the ticket was poorly written

    not bad, its the minimum. But we're 90% sure it will be thrown out in court because a bunch of other people under the same circumstances had their cases thrown out, enough people to make it a class action. That and the fact they refused my blood testing.

    I still don't see why they're relaxed, it's still over the limit. How far over the limit can you be before they finally say "Ok yeah now you're too drunk to drive"? .085? .1? .2? It's ridiculous. And on St. Patricks Day too, where EVERYONE is gonna be drinking. If anything, that's a day where they should be more strict about the law, not more lenient. Great system we have in this country.

    because:

    1) they couldnt prove i was intoxicated.
    a) they refused an on sight blood test
    b) the officer issuing me a ticket didn't verify the volunteers findings
    2) by the time thye took me to the station to take a blood test i wouldve been under the legal limit, at which point i could sue for a wrongful arrest.



    It is better to dish out a ticket and hope i dont fight than to face potential lawsuit

    Not to mention other people in my car as well as at the check point were FAR more drunk than I was.

    Couldnt prove it? You BAC was over the legal limit. Period.


    Ive NEVER heard of ANY department that does blood tests in the field. NONE. And you wont see any LEO drawing blood. Ever.


    Not necessarily true- as time passes one's BAC will INCREASE depending on when the alcohol was last consumed and enters the blood stream.

    This is as far from a fact as possible.



    Again...way off base.

    Which isnt illegal in the slightest. YOU are the driver- everyone else in the car can be half dead by alcohol. They arent driving, thus not breaking any laws.

    All that being said- its the officers discretion to cite you, arrest you, have someone pick up your car and you get a ride from someone else, etc. All depends on your attitude and your actions. There IS a grey area around the .80 BAC limit that allows an officer to use discretion.
    That discretion is just that..his discretion, and is the reason that he let you go, NOT because of the reasons above.
