speeding ticket

    speeding ticket

    if they somehow manage to write the wrong license plate number, are you still obligated to pay the ticket fine?

    Nope. Take it to court. I know stories where people (mostly in new york) change the emblems on their car to a different make because of parking tickets. The cop will right down Audi when its really a Toyota and the ticket will be null in court because you dont own an Audi.

    well he wrote an "S" and not a "5" on the ticket. It's not showing up on their system YET. Going to have to see..by the end of this week.


    Thankfully I'm in one of the 3 states that won't reflect my out-of-state ticket in my home state record. (Pennsylvania, Colorado are the other two.)

    About those stories you mentioned, the cops here in NY usually look at the sticker (forgot what the name of the sticker is) next to the NYS inspection sticker which tells the VIN# YEAR MAKE MODEL, etc. I don't think the emblems would help much here..just my personal opinion since I've seen cops write tickets and all of them look at the license plate and then walk up by the driver side to read that sticker. I think that sticker actually has a barcode which they scan and it would put in all the info for them before they print the ticket out.

    In most jurisdictions, writing down the wrong information will NOT get you out of the ticket. Officers can update the information up to the court date anyways. So lets say you take it to court......you plead not guilty. What are you going to say? "Your honor, he wrote down the wrong license plate number". Judge will then say "Okay...then why did YOU get the ticket?" Then you say "Uh...cuz he pulled me over". It wont hold up in court. The fact that he personally wrote you the ticket will supercede the mistake on the ticket. (And most likely, the rest of the information on the ticket has YOUR information on it. How would you explain that....."Your honor, he mustve pulled someone else over because he has the wrong plate on here.....and whoever he pulled over mustve had my drivers license with them, and was driving the same color, make, model of car)

    Your infomation is inputed, and if there is a discprepancy, it will be corrected by the clerk.

    And do some research on the members of the Drivers License Compact Agreement: http://www.1800duilaws.com/common/dlc_nrvc.asp All states are members except for Michigan, Wisconsin, Georgia, Tennessee (dropped out in 1997) and Massachusetts

    Your state DOES share information....but most likely its like most other states in that it only keeps record of major moving violations.

    Thats exactly what they are....STORIES. And a parking ticket is a different situation than a speeding ticket.


    Do you also believe that an officer is obligated to show you the radar reading? (Which they do NOT have to do. This has been taken all the way to the Supreme Court, and an officer does NOT have to show you the reading. As a courtesy they can, but they are not obligated).

    But he can be like well this is not my license plate number. Why would I pay a fine for someone else? If the officer made the mistake then thats his fault.

    Are you talking about the officer signing the ticket? because I didnt have to sign anything..

    well i'm just going to argue that he wrote down i was speeding in a 55mph area when i know it was a 65mph area. do you think i have a better chance arguing that since it's really hard for both parties to prove exactly which speeding zone i was pulled over in?

    THAT is something that you should bring to the attention of the courts. Only if youre 100% positive it was a 65 mph zone

    You'd need to prove you were going 55mph (ur word means nothing cause anyone can say they were going the speed limit). How fast does it say you were going on the ticket?

    80 but i was just goin with the flow of traffic. and no, im not gonna use that as my argument that i was singled out.

    im not tryin to say i was going 55mph. im trying to bring up the speed limit to 65mph so the fine would be less....... who goes 55mph anyway unless the speed limit was 45.

    Oh and no matter you won't get off on an officers mistake. My wife was pulled over in Arlington 2-3 years ago and was given a ticket for speeding and not wearing a seat belt.

    On the speeding ticket the officer wrote the wrong violation code. Instead of speeding, he wrote down the "illegal suspension modifcation" code which requires a court visit. She still had to pay the speeding ticket and she still had to show up in court. However, it was a headache to get that violation code fixed. so don't think that you can easily get off cause of a minor mistake. Although your ticket is minor compared to the headache we had to get things straightened out.

    If you are 100% sure, then go back and take pictures of the speed limit sign and the area you were pulled over in. To make things easier for you, draw it up on some poster board and take that with you and show the judge exactly where you were and how far you were from the sign that read 65mph.

    Something similar happend to an old teacher of mine. He was in DE and was nailed while he decreased from a 55mph zone to a 45mph zone. He wasn't even in the 45mph zone and the cop said he was speeding in a 45mph zone. he took pics, drew up a diagram to show where the 55mph zone was and where he was in relation to the 45mph zone. He drove back down to DE and fought it. He won the case.

    ^^yea but dont take that to traffic court....they'll laugh at you...you're just suppose to declare whether you believe you are guilty or not guilty....when you come back to present ur case is when you should do this diagram thing if thats what you plan to do...

    so the first visit is just pretty much pleading guilty or not guilty? and then what happens? does the judge ask you if you want a reduced fine and etc etc so you wont have to visit the court again?

    your best bet is to actually talk to someone at the courts to see how things work. unless you know of someone who has gone to court before in NY that pleaded not guilty.

    It is different in every jurisdiction. In MD, If you submit a not guilty plea, youre given a court date and ya show up. (Still traffic court) If you plead guilty with explanation, youre given a court date and ya show up. (traffic court) Guilty pleas and not guilty pleas are in the same room.

    This is CALIFORNIA ONLY That entire site deals with California law



    CVC 40902. (a) (1) The court , pursuant to this section, shall, by rule, provide that the defendant may elect to have a trial by written declaration upon any alleged infraction, as charged by the citing officer, involving a violation of this code or any local ordinance adopted pursuant to this code, other than an infraction cited pursuant to Article 2 (commencing with Section 23152) of Chapter 12 of Division 11.


    CVC 40902 (d) If the defendant is dissatisfied with a decision of the court in a proceeding pursuant to this section, the defendant shall be granted a trial de novo.

    vibebreaker, when you go to court just tell the judge that you'll do community service and pay a partial fine. Plus, don't forget to wear a collared shirt. btw, slow it down a little, keep your car dirty and travel in the center lane. Be safe :D

    I don't think in every state you have to sign anything. When I got tickets in NJ, they just handed me a ticket and i didn't sign anything. Once I moved to VA, I had to sign tickets only saying that I understand why I was pulled over and that the cop explained everything to me.

    dude, if you plea not guilty, they WILL give you a reduction and then you sign the papers with you agreeing to the reduced terms.

    if i can get half the fine w/o the points, why would i plead guilty?

    I would pretty much say that your screwed with the ticket and the fine. I actually had something similiar happen to me....officer wrote down the wrong color of my car. He wrote "silver" when in fact my supra is "gray". lady at the office told me it makes no difference. sometimes even officers make mistakes.
