So last night around 11pm me and my buddy were riding in his car, he was speeding for a while but i didnt care. He is going about 45-50 in a 30mph zone and as im looking out the window i swear i saw a police car to my right. I let him know and he panics. LOL We are near my house so my friend decided to drive through the neighborhood trying to loose the cop by taking left/right turns till we got home. He gets out of the car and runs to my back yard o_O So i just go inside my house like nothing and next thing you know a cop knocks on the door and ask for the driver of the vehicle he pointed at (buick le sabre?) So i go get my buddy and he writes him a ticket, on my porch! Im like WTF? "We are inside the house, we weren't driving so how can you give us a speeding ticket man?" He proceeds to write the ticket, finishes, my friend signs the ticket and then the cop leaves...

So my question is can he actually fight for this ticket? This is by far one of the dumbest tickets ive seen so far...

If he got him while he was doing the 45-50, then that's all he needs, right?

You can fight the ticket like any regular old ticket, but yeah they can do that.
I think California law actually states you can be ticketed for driving related things up to a year after it happened.

    retarded right....

I meant if he clocked him on the radar while speeding, he can give you a ticket.
    Added: Aug 1, 2012 6:25 PM
You ran away from him, and the police pursued. And he got ya at the end, just like always.
    Added: Aug 1, 2012 6:25 PM
I suppose the police wasn't trying to be an idiot driving like your friend through a residential neighborhood at night.

Your friend was speeding, he got caught, so he gets a ticket. Doesn't matter if he got you at your house. That's like killing someone and going home. Then the cops find out it's you that did it, go to your house and arrest you. Would you fight it because you were "on your couch"? No.

Just like when the police is in the median, and clocks me speeding when I'm half a mile away. Then I see the car, slow down and go past, and when he pulls me over, I say "but I wasn't speeding right this second!"

You should have asked to see the display on the radar gun. Either way, your buddy got caught. That cop is just doing his job.

exactly, I've only had two tickets ever and I got completely out of the second one by asking to see when the cops radar was last calibrated.

Also, in no state is an officer required to show you the reading on the radar/laser gun. You have every right to challenge the accuracy of the laser/radar gun in court, but they dont have to show you the reading.

There are many reason for this- for one, its a safety issue letting the driver walking around the road. Secondly, many systems are fixed in the car- its another safety issue allowing the driver to get in the front seat of a cruiser with the car running, shotgun between the seats, etc etc etc.

technically! *coming from a COP in law school* We DO NOT have to show you anything BUT if you take it to court then you can ask to see the evidence and the officer will have to bring his radar gun and show proof that it was your friend's car he clocked going that fast
