You're missing the point Movie. It's not about how you can get out of the ticket, or how you think you can sue the state.

It's about the fact you knowingly got hammered, and got behind the wheel and drove. You better count your lucky stars you didn't hurt anybody, or get in an accident and kill someone. Or yourself.

You come on to the forum to brag about getting a DUI, which will be on your record, then you sit here and defend your self?

IMO, getting drunk isn't cool even if you’re sitting at home on a Friday night. But then to get in a car? Then to try and bs your way out of it? Number 1, take responsibility for your actions and number 2 don't endanger innocent people with your reckless actions. It’s the same concept as street racing; it may be fun but you’re endangering the lives of other motorists and possibly whole families. Learn responsibility before you get behind the wheel.

when an officer has probable cause they can detain you which is different than arresting you.

most of the time i call out the truth instead of believing a fantasy about cars and most people don't want to hear the truth about the car they drive so they think i'm an asshole. i will gladly own up to the name though.

His luck it would have been a SUV full of kids, manslaughter charges would have been nice as well.

Yes I have ZERO SYMPATHY for you, I luckily walked away for a lady who was 3X over the legal limit and rear ended me at 70mph.

    Drinking and driving is FTL!!!!!!!!

I didn't get hammered. 6 drinks over 4 hours i shouldve blown a .06. the math has been done. Which is far below the legal limit. I was denied verification testing.

fairly, 99% certain, as far as dui's pertain at checkpoints, the officer cant use probably cause. they have to follow a pattern of every car is pulled over and checked, every other car, ect ect. they cant use probable cause at a check point, which is what he did. I dont have the court case on hand that made it illegal to use probable cause at a check point, but its written into the law here in CO. So the fact he pulled me over wtih probable cause is grounds for dismissal.

btw you people are missing the point. I wasn't smashed, and I should've blown well below the legal limit. I was denied blood testing, and a second test by a badged police officer. I didn't get a fair test, a second test that would've cleared me of all charges before having to go to court.

do the math, 6 drinks @ 4.2% alcohol per drink (coors light). 4 hours. 170 pounds. = .06ish. Not to mention the food, and 3 glasses of water I drank.

Not to mention, there is a class action suit for people in the exact same situation because officers were dishing out questionable duis to people who werent intoxicated, all of which get the charges dropped and expunged.

No, we are getting "your" point quite clear. You on the other hand, are not getting "the" point. It doesn't matter if the math is a little bit off or not. Putting people's lives in danger can't be justified because of 3rd grade mathematics. You were over the legal limit. You were driving. End of story, kthanxbye

    Drinking + Driving = bad.

Nope, it's on Anandtech as well.

I'm fairly 99% certain that you aren't as familiar with the laws as you think you are. Reasonable suspicion is needed for a stop, not probable cause. If you find a law that says vehicles passing through checkpoints are exempt from state and local laws as long as they are not the designated vehicle in line to be stopped, I'd sure love to see it.

Agreed, certain people can't blow a .02 without getting into major trouble (truck drivers is one)

    Its not an exact science.

You dont really seem to get it. So youre saying that you were going through a checkpoint? If the officer wanted to detain you because he thinks youre under the influence, thats in his right. Thats his probable cause.

You said you were denied blood testing in the field. Which blood testing doesnt occur in the field. Did he do any field sobriety tests on you?

Lets say it again....its not an exact science.

Got a link to it? cant seem to find anything about it
