    Damon Wells is the man gun supporters were imagining when they fought for the right to carry concealed weapons.

    He had a permit to carry his gun, and he had the gun on him when a pair of teenage thieves approached him Saturday night on his front porch in Cleveland.

    When one of the youths pulled a gun, Wells drew his and shot one of the boys several times in the chest, police said. Arthur Buford, 15, died after stumbling away and collapsing on a sidewalk near East 134th Street and Kinsman Road.

    City prosecutors decided Monday that Wells, 25, was justified and would not be charged for what appears to be the first time a concealed-carry permit holder has shot and killed an attacker.

    Nonetheless, the shooting reignited the debate that flared three years ago when Ohio's concealed-carry law took effect.

    Gun supporters said the weapon saved Wells' life. Opponents said it took Buford's - that the 15-year-old might be alive if a citizen had not been armed.

    An angry throng of about 30 youths gathered Monday and set up a memorial at the intersection where Buford, a freshman at John F. Kennedy High School, died.

    His cousin, Tameka Foster, 21, questioned why police did not punish Buford's shooter.

    "They let that man run out freely," Foster said. "My cousin is dead."

    Buford's accomplice disappeared after the shooting and had not been caught as of Monday night. Police found a .38-caliber handgun in the mail chute of a nearby house. They believe it belonged to Buford or the other suspect, Lt. Thomas Stacho said.

    Police took a .40-caliber Smith and Wesson firearm from Wells as evidence, the police report shows.

    Both sides of the gun debate said it was sad that a teenager died.

    "It's tragic," said Jim Irvine, chairman of the Buckeye Firearms Association. "Anytime somebody dies, it's tragic, but it's hard to have any sympathy when he chose to have a gun and go threaten somebody's life."

    Irvine said it was "great that a potential victim is able to continue his life instead of having a criminal take it."

    Toby Hoover, of the Ohio Coalition Against Gun Violence, said she had not heard of any other fatal shooting involving a concealed-carry permit holder.

    "This is one of the few where they actually used it to stop a crime," Hoover said.

    But, she said, "there's still a dead kid here."

    A man who answered a phone number for Wells refused to comment and hung up. No one answered the door at Wells' home.

    Well maybe if your cousin didn't try to rob someone with a gun... The stupid kid got what he deserved. I'm sick and tired about hearing how stupid the youth of today is. I'm still pissed about the two 16 year olds that poured industrial strength cleaner with sulfuric acid on a playground slide, leaving a 2 year old to suffer. He had to get skin grafts to around 75% of his body. Then, this weekend, we had to deal with fucking 12 year old lying pyromaniacs setting fires in the woods... and it's not the first time either. They probably set the fire that my friend had to put out the other night as well.

    Its understood the kid died. But do they not realize what he was doing? HE broke the law.

    Yes your cousin is dead, yes your classmate died...but he died because he broke the law and nothing illegal happened when he was shot...it was justified. I know in Manassas, VA they have a list of justified killings. One of them is that you can kill a burgler that enters your home, but he has to be shot in the chest and facing you. he must also remain on your property. Something simliar to what happened here, minus the breaking into a home.

    Now, could he have taken control of the situation before shooting the kid? Maybe. I'm sure thats what people will try and argue. I personally see it as justified. The kid trespassed onto his property, held a gun to him and threatened him.

    So they are upset because a kid died trying to kill another man? And what more if the kid did survive...he would've shot Well's, killing him. Furthermore, he probably would've continued shooting others. Well's seems like a responsible man who used his concealed carry privileges appropriately. If I had to be brutally honest, I would go as far as saying that Well's did the world a favor by taking this kid, who would've probably grown up to be a burden on society, off the streets. Kid or not, he made a poor decision and if he had survived, probably would've been convicted as an adult or something....but I dunno specifics about the law so don't quote me on that...

    America's become the land of "Someone else's fault" It's like, "Ohhhh, it's someone else's fault my poor innocent saint of a gun toting thug child was packing....they shouldn't have killed him for pulling that gun! Gah! He coulda put him in time out instead!"
    I just see it as an important lesson for punkassed kids to consider. If you're going to make grown up decisions, accept the grown up consequences. And if the family doesn't want them to end up dead they might want to do a better job of raising them....instead of leaving them to run wild in the streets.

    I think the main root of the problem is the parents though. They're apparently not doing their job of instilling morals and what's right and wrong with their kids. It's fucking ridiculous.

    Speaking of parents being at fault, I saw something on the news the other day about a truancy law they're either trying to pass or have already passed in Oklahoma. I dunno if our state is a little late in the game.....but....they're trying to make parents responsible if their child misses too many school days. Any child under the age of 16 who has missed more than a certain amount of days of school, will be brought to the attention of the school and to the state, at which point the state will prosecute the parents and make them serve jail time for neglect or something like that. Any child over the age of 16 has to report themselves though...

    Thats how it is back home in NJ. If you miss so many days, they take the child and parent(s) to court and they get a warning. The second time will land them a fine. And the third time will land them in jail (I don't know how long).

    shit they should do that and that kid deserve to be kill it aint that guy fault for killing him, shit if it was me id do the same thing n o yeah same thing kinda happen n Sacramento group of kids try to steal the guy car and i think he shot one of them but he got away with cause they try to rob him and he shot them n self defense

    It's either kill or be killed. We were going over the age at which an individual can tried as an adult in class. It's now 14 in California. So if at that age you can make decisions with that developed brain, you must be also responsible for your actions. No pity for the kid over here. I say the guy should have shot the other one too. And I agree with bad parenting. Kids are running wild while the parents are cluelessly runny their own lives oblivious to anything else. Its just like how the Columbine and the Virginia Tech shootings ended up. The parents and superiors did nothing to prevent or stop tragedies from happening. So a kid died. So what. He was committing a crime and he paid the price. They should fine and prosecute the parents too for letting him assault someone with a weapon. That would teach other parents to watch their damn kids.
